By using this Platform you acknowledge that you have read, understood and agreed to these Terms of Service.

General

These Terms of Service ("Terms") govern your access to and use of the web platform (the "Platform" or "Services") operated by ADVDOC NEXUS LLC a company incorporated under the laws of Florida (USA), EIN 42-2447198, with registered office at 111 NE 1st Street, 8th Floor #8918, Miami, FL 33132 ("Company", "we", "us", "our"). The Platform is accessible at https://tracecheck.com and is not affiliated with any third-party platform, social media network, or government registry.

Accessing or using the Platform constitutes your acceptance of these Terms. If you do not agree, do not access or use the Platform.

We reserve the right to amend these Terms at any time. Continued use of the Platform after publication of updated Terms constitutes acceptance. We recommend periodic review.

If any provision is held invalid by a competent court, the remaining provisions shall continue in full force and effect.

Services and License to use

TraceCheck is an online public records search platform that enables users to look up publicly available information associated with a phone number. The Platform provides access to that information by connecting exclusively through paid, contractually authorised third-party APIs. It does not scrape, crawl, or independently collect data,it acts solely as an aggregator and presentation layer over those licensed data sources.

Supported Search Modalities

The Platform currently enables the following search modality:

  • Phone number lookup: the user submits a phone number; the Platform queries authorised public records API providers to return publicly available information associated with that number. Results may include, to the extent available from the applicable data sources at the time of the query, publicly accessible registration data and publicly reported activity linked to the submitted number. The nature, scope, and availability of results vary by number type, geographic region, and data provider and are not guaranteed.

Intended Use Cases

The Platform is designed for the following personal, non-commercial purposes:

  • Looking up publicly available information associated with an unknown phone number;
  • Obtaining publicly available background context about an individual or contact for personal informational purposes;
  • Accessing publicly available records associated with a phone number for personal decision-making.

Data Sources

The Platform retrieves data exclusively through paid, contractually authorised APIs from licensed third-party data providers. The two categories of underlying data accessed through those APIs are:

  • Public records data: information drawn from publicly accessible records and databases made available through authorised licensed API providers. The specific fields and data points returned depend on the data provider queried and the information available at the time of the request. Availability and completeness vary and are not guaranteed.
  • Licensed aggregated data: datasets compiled and licensed by authorised third-party suppliers from publicly available sources.

While we select our data providers carefully and require contractual representations as to the lawfulness and accuracy of their data, results may be incomplete or outdated. Users acknowledge and accept these inherent limitations. For further information on how We handle data, please refer to our Privacy and Cookie Policy.

Protection of Minors

The Platform is strictly prohibited from being used to search for information relating to minors (persons under 18 years of age). To the extent that our licensed data API providers include age-gating and suppression mechanisms in their datasets, we rely on and contractually require such protections. Any attempt to use the Platform to search for, compile, or access information about a minor is a material breach of these Terms and will result in immediate account termination and may be reported to the appropriate authorities.

What the Platform Does NOT Do

The Platform does not and shall not:

  • Access private databases, accounts, or non-publicly accessible communications;
  • Perform direct web scraping or crawling of any website;
  • Retrieve or display credentials, private messages, financial account data, or medical records;
  • Offer facial recognition, regulated identity verification, real-time GPS or location tracking, or device monitoring;
  • Provide real-time results , all outputs reflect information available at the time of the search from the API providers queried at that moment.

License to Use

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable licence to access and use the Platform solely for your personal, non-commercial purposes. This licence does not grant any ownership rights to the Services, Content, or data accessed through the Platform.

This licence automatically terminates if your access is cancelled, terminated, or restricted. All rights not expressly granted are reserved.

Accounts and access

Registration

To access and use the Services, you are required to provide a valid email address. Users are permitted to perform one (1) search without registering. Full access to the Platform requires account registration and subscription. By registering, you agree to provide accurate, current, and complete information and to update it promptly if it changes.

You are solely responsible for maintaining the security of your account credentials and ensuring that no unauthorised party accesses your account.

Individual Use; No Multiple Accounts

Access to the Platform is intended for individual use only. You may not create multiple accounts using different email addresses, or transfer access to another person or entity, without our prior written consent. We reserve the right to refuse, restrict, or terminate access to the Services if fraudulent or unauthorised activity is detected.

Age Requirement

The Platform is exclusively available to individuals aged 18 or over with full legal capacity under the laws of their country of residence. By using the Platform, you represent and warrant that you meet this requirement.

Account Deletion

Users may request permanent deletion of their account, including all associated data, by contacting our Customer Support via email info@tracecheck.com. Upon deletion, all stored data and unused credits are permanently removed. Users may subsequently create a new account using the same email address.

For security reasons, deletion requests must be sent from the email address registered to the account. We may ask you to verify your identity before the request is processed.

Geographic Availability

The Platform is available globally, with primary focus on users in the United States, United Kingdom, Canada, France, Germany, Italy, and Spain. We may restrict access from certain jurisdictions at any time at our sole discretion, without prior notice. Accessing the Platform from a restricted jurisdiction is at the user's own risk.

Content

The information provided through the Platform ("Content") is intended solely for informational purposes. Content is derived from publicly available sources and licensed data, which may contain inaccuracies, outdated information, or omissions.

Content is not real-time. You acknowledge and agree that Content reflects information available from applicable sources at the time the report is generated and may not reflect subsequent updates, corrections, removals, or changes. The same search may return different results at a later time.

By using the Services, you acknowledge and agree that the Content:

  • Is provided "as is" and is subject to inherent limitations based on the nature of the data sources;
  • May not be used as a substitute for professional advice or relied upon for legal, financial, employment, or other critical decision-making purposes;
  • Is not guaranteed to meet your specific needs or expectations.

You are solely responsible for how you use the Content and for any consequences arising from your reliance on it. You agree not to resell, distribute, reproduce, or share the Content with any third party without our prior written consent.

Without limiting the foregoing, Content is for your personal, internal use only. You may not publish, post, transmit, upload, screenshot for distribution, forward, or otherwise disclose any Content to any third party. This restriction applies specifically to any "Cached Reports" or "Reports History" outputs (if enabled) and remains in effect unless and until we expressly enable a sharing feature and you are presented with separate terms governing that functionality.

You may not remove, alter, obscure, or circumvent any technical limitations, access controls, watermarks, notices, suppression/opt-out mechanisms, or other safeguards that we implement in connection with the Content or the Services.

If you believe any Content is inaccurate or outdated, you may contact our support team. While we may in our discretion review and address concerns, we have no obligation to update, correct, or remove Content unless required by applicable law.

SUBSCRIPTION PLANS, PRICING AND PAYMENT

Access Tiers

Users may access the Platform under three access tiers:

  • Introductory Trial: new registered users may begin with a paid trial, which includes a limited number of lookup credits. At the end of the paid trial period, the trial converts automatically to the Monthly Subscription unless cancelled before the trial period ends. The duration, price and specific number of lookup credits included for the Introductory Trial will be adequately informed within the website and prior to the completion of payment by the User.
  • Monthly Subscription: full access to the Platform with a monthly allocation of lookup credits. Billed automatically each month until cancelled. Pricing displayed on the billing page prior to purchase prevails and is confirmed by email after payment.

Subscription Plans

The Platform offers a single recurring subscription plan:

  • Introductory Trial: The duration, price and specific number of lookup credits included for the Introductory Trial will be adequately informed within the website and prior to the completion of payment by the User. Converts automatically to the monthly plan at the end of the trial unless cancelled beforehand.
  • Monthly Plan: recurring monthly billing. Includes a monthly allocation of lookup credits. Unused credits from the subscription plan expire at the end of each billing cycle. Billed automatically each month until the subscription is cancelled.

Prices for users outside the United States will be converted to local currency. The price confirmed at checkout is the binding price for that transaction.

Add-ons (One-Time Purchases)

Users with an active subscription may enhance their plan with the following optional one-time purchase add-on:

  • Unlimited PDF Downloads: enables unlimited downloading of search reports in PDF format while the subscription remains active. Access to this feature is tied to the subscription; if the subscription is cancelled, PDF download access ceases at the end of the billing cycle.

Additional Credits

Users may purchase additional lookup credit packages at any time. The available packages and price and conditions applicable to each of the offered packages will be adequately informed in our Website and, in any case, prior to the completion of the payment by the User.

Once purchased, the additional credits packs will expire and, therefore, will stop being available for User to use, when any or all (alternatively or cumulatively) of the following circumstances are met:

(i) the User unsubscribes from the then current active subscription plan.

(ii) after 12 months of the date of the additional credits pack’s purchase by the User.

Prices outside the United States will be converted to local currency. The price confirmed at checkout is the binding price for that transaction. Credit packages are non-refundable once purchased.

Billing and Auto-Renewal

Subscription fees are billed automatically to the payment method on file on a recurring basis. Payments are processed by ADVDOC NEXUS LLC through a PCI-DSS-compliant payment provider. Subscriptions auto-renew unless cancelled before the end of the current billing cycle.

In the event of a failed payment, we will attempt to process the charge multiple times. If the payment remains unsuccessful, your account may be suspended and access restricted until payment is resolved.

We reserve the right to modify pricing upon notice published on the Platform. Existing subscribers will be notified prior to any price change taking effect.

Cancellation and Unsubscription

You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing cycle. Access to the Services continues until the end of the paid period. Cancellation does not entitle you to a refund for the remaining unused period, except as required by applicable law (see Section related to Right of Withdrawal).

Refund Policy

Refunds will not be provided for:

  • Partial or unused subscription time after cancellation;
  • Changes to subscription plans or features;
  • Failure to cancel before the next billing cycle.

Refunds may be available only in the following specific circumstances: (a) the trial fee, if requested within 7 days of purchase and no credits have been used; (b) service unavailability exceeding 24 hours (excluding scheduled maintenance or force majeure); or (c) billing errors such as duplicate charges or incorrect amounts. Refund requests must be submitted within 30 days of the charge via our support team, with account email and transaction details provided. Refunds are processed to the original payment method within 3–5 business days.

Right of Withdrawal. EU/EEA and UK Users

If you are a consumer located in the EU/EEA or the UK, you have a statutory right of withdrawal of fourteen (14) calendar days from the date of subscription. If you request and receive access to Platform features before expiry of the withdrawal period, you expressly acknowledge that the Services will be provided during that period. Upon withdrawal before expiry, you may be charged a pro-rata amount for Services already consumed. Technical Means for Correcting Errors

If you detect an error in your account information or payment details, you must correct it via your account settings or by contacting info@tracecheck.com.

PROHIBITED USES

You may use the Platform only for lawful purposes and in accordance with these Terms. You are strictly prohibited from using the Platform, its Content, or its Services:

FCRA-Regulated and Employment-Related Uses

  • To evaluate any person's eligibility for credit, insurance, employment, housing, government benefits, or any other purpose regulated by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq.;
  • To screen job applicants, assess creditworthiness, or make tenancy or housing decisions;
  • To conduct background checks for any regulated or commercial purpose.

Harassment, Stalking, and Privacy Violations

  • To stalk, harass, intimidate, threaten, dox, or monitor any individual;
  • To track the real-time location, movements, or activities of any person;
  • To compile a profile or systematic record of any individual's behaviour, characteristics, or activities;
  • To invade any person's right to privacy, or to enable any third party to do so.

Minors

  • To search for, access, compile, or process any information relating to a person under the age of 18 (a "minor");
  • To facilitate contact with, or to enable the location of, any minor for any purpose.

Commercial Exploitation and Data Resale

  • To resell, distribute, reproduce, sublicense, or commercially exploit the Content or any data obtained through the Platform;
  • To aggregate, compile, or export data for use in another product, database, or service;
  • To use automated scripts, bots, crawlers, or scraping tools to extract data from the Platform.

Deception and Fraud

  • To impersonate any individual, entity, or organisation;
  • To provide false or misleading information during registration or use;
  • For any illegal, deceptive, fraudulent, defamatory, obscene, offensive, or privacy-invasive purpose.

Platform Integrity

  • To reverse-engineer, decompile, or extract source code or proprietary data from the Platform;
  • To interfere with, disrupt, or gain unauthorised access to the Platform's systems or infrastructure;
  • To circumvent any technical safeguards, access controls, opt-out mechanisms, or suppression flags;
  • To remove, alter, or obscure any watermarks, notices, or attributions in the Content.

IP and Legal Violations

  • To infringe the intellectual property rights of the Company or any third party;
  • To violate any applicable local, national, or international law, regulation, or court order;
  • To initiate debt collection, skip-tracing, or asset recovery for third parties using Platform results.

We reserve the right to suspend or terminate your account immediately and without refund upon detecting any prohibited use. We may also report suspected illegal activity to the appropriate authorities.

CODE OF CONDUCT

In addition to the prohibited uses in the previous Section , you agree to use the Platform in good faith, ethically, and in compliance with all applicable laws and regulations. Specifically:

  • Any unauthorised use of the Platform is expressly prohibited;
  • You may only input personal data corresponding to your own identity or an identifier (phone number) you are authorised to query;
  • You must use the Platform solely for general, informational purposes and must not use results to make decisions about individuals or create profiles on their behaviour, characteristics, or suitability for any purpose;
  • You must not defame, harass, threaten, or harm third parties;
  • You must not take any action that interferes with the proper functioning, availability, security, or integrity of the Platform.

The Company makes no guarantee regarding user behaviour and will not be held responsible for damages caused by inappropriate use. The Company reserves the right to block or eliminate access for any conduct contrary to these Terms, good faith, or applicable law. The Company may use automated systems to detect and restrict prohibited uses without prior human review.

AVAILABILITY, CONTINUITY AND UPDATES

  • We make best efforts to ensure Platform availability at all times, but cannot guarantee uninterrupted access. Service may be temporarily unavailable due to maintenance, updates, or events beyond our reasonable control.
  • We do not guarantee Platform availability in all jurisdictions. We may limit availability or specific features to users from certain geographic locations at any time. Access from an unauthorised jurisdiction is at the user's own risk.
  • We may add, modify, or remove features and functionalities at any time. Material changes to the Services will be notified via the Platform or by email.
  • Updates to the Platform may affect functionality. We recommend keeping your browser updated for optimal performance.

DATA PROTECTION AND PRIVACY

We are committed to protecting your personal data. Our collection, use, storage, and processing of your data is governed by our Privacy and Cookie Policy. The Privacy Policy is incorporated by reference into these Terms.

By using the Platform, you acknowledge and consent to the processing of your personal data as described in the Privacy Policy. This includes, where applicable, your rights under the GDPR (EU Regulation 2016/679), the UK GDPR, and applicable national data protection laws.

We have implemented appropriate technical and organisational measures to safeguard the confidentiality and integrity of your data. You are advised to exercise caution when entering personal information into the Platform. We are not responsible for security incidents arising from factors outside our reasonable control.

FAIR CREDIT REPORTING ACT (FCRA). U.S. USERS

OUR SERVICES ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DO NOT FALL UNDER THE DEFINITION OF A "CONSUMER REPORTING AGENCY" AS DEFINED IN THE FAIR CREDIT REPORTING ACT ("FCRA"), 15 U.S.C. § 1681 ET SEQ. WE DO NOT PROVIDE PRIVATE INVESTIGATOR SERVICES. THE INFORMATION WE PROVIDE IS NOT COLLECTED, MAINTAINED, OR FURNISHED FOR THE PURPOSE OF MAKING DECISIONS ABOUT AN INDIVIDUAL'S ELIGIBILITY FOR:

  • CREDIT, INSURANCE, OR FINANCIAL PRODUCTS FOR PERSONAL, FAMILY, OR HOUSEHOLD USE;
  • EMPLOYMENT DECISIONS, INCLUDING HIRING, PROMOTIONS, OR TERMINATIONS;
  • HOUSING OR TENANCY EVALUATIONS;
  • EDUCATIONAL ADMISSIONS, GOVERNMENT BENEFITS, OR OTHER REGULATED DETERMINATIONS.

AS WE DO NOT PROVIDE FCRA-REGULATED SERVICES, THE OBLIGATIONS AND PROTECTIONS APPLICABLE TO CONSUMER REPORTING AGENCIES UNDER THE FCRA DO NOT APPLY TO THE USE OF OUR SERVICES.

You are strictly prohibited from using information obtained through the Platform for any purpose that would require FCRA compliance. Misuse may result in account termination and legal consequences under federal law. It is your sole responsibility to ensure your use complies with all applicable laws. If uncertain, consult a qualified legal professional.

Merchants of Record

Please be informed that the payments made through the present website as well as applicable other recurring payments can be managed for the following Merchant of Record:

ADVDOC NEXUS LLC, a private company with TAX ID number 42-2447198, and its registered office at 111 NE 1st Street, 8th Floor #8918, Miami, FL 33132.

All Merchants of Record may make and manage the collection of the total costs of the subscription plan chosen by the User and, when appropriate, will approve and issue refunds expressly requested by the Users with the support of their payment services providers.

Please note that the User's payment information is transmitted directly, via a secure connection, to information systems of the payment services providers. Therefore, we do not have access to, nor store, the User's complete payment card data. All our payment services providers have put in place the maximum measures to ensure the reliability and security of communications and interactions between the Users of the present website and their payment gateways.

Furthermore, the Company will issue an invoice for the charges made, when requested by the User. In this regard, The User expressly authorizes the Company to send the invoice in electronic format, although it is possible to indicate to our Customer Service if you wish to receive a paper invoice, in which case we will send it in this format to the postal address you will provide. Moreover, the User can contact both our merchant of records to request and obtain an invoice.

Please be informed that the Company reserves the right to collaborate with other third parties to collect the costs of the subscription plan.

INTELLECTUAL PROPERTY

All intellectual property rights in the Platform, including source code, databases, software, design, text, graphics, logos, trademarks, and interactive features (the "Platform IP"), are owned by or licensed to the Company. Access to the Platform does not transfer any intellectual property rights to the user.

The licence granted in this Terms and Services does not permit you to copy, reproduce, republish, distribute, create derivative works from, reverse-engineer, or extract any Platform IP. The Company reserves all rights not expressly granted and will take all available legal action in the event of infringement.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or in connection with:

  • The use of or inability to use the Platform or its results;
  • Inaccuracies, incompleteness, or errors in Content derived from third-party API data sources;
  • Any decisions made by you or third parties based on information obtained through the Platform;
  • Unauthorised access to or alteration of your data;
  • Interruptions, delays, or discontinuations of the Platform.

The Platform and Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. The Company shall not be liable for: (a) the content of user inputs; (b) user misuse of results; (c) damages caused to third parties through misuse of the Platform; or (d) circumstances beyond the Company's reasonable control.

Nothing in these Terms limits liability that cannot be excluded under applicable mandatory consumer protection law. EU/EEA and UK consumers retain all statutory rights.

TERM AND TERMINATION

These Terms remain in full force and effect while you access or use the Platform. The Company reserves the right to deny, suspend, or terminate access to the Services at any time, at its sole discretion and without notice or liability, including by blocking IP addresses.

Upon termination for any reason, all licences granted to you cease immediately. Content , Prohibited Uses, Fair Credit Reporting Act , GDPR and EU/EEA User Rights , Intellectual Property , Limitation of Liability , Applicable Law and Jurisdiction (Section , and Disclaimer. In addition, any payment obligations accrued prior to termination, any indemnification obligations arising from your use of the Platform, and any provisions that by their nature are intended to survive termination shall also remain in effect notwithstanding termination.

APPLICABLE LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Spain. Any dispute shall be subject to the exclusive jurisdiction of the competent courts of Barcelona, Spain.

Users who qualify as consumers under EU/EEA law may bring proceedings before the courts of their place of domicile and may access alternative dispute resolution mechanisms under Regulation (EU) No 1215/2012. EU users may use the European Commission's ODR platform at https://ec.europa.eu/consumers/odr.

The failure of the Company to enforce any right shall not constitute a waiver. Rights may only be waived expressly and in writing or by statute of limitations under applicable law.

DISCLAIMER

TraceCheck does not provide consumer credit reports and is not a consumer reporting agency as defined by the FCRA, 15 U.S.C. § 1681 et seq. The Platform currently supports searches by phone number only. Information available on the Platform may not be 100% accurate, complete, or up to date; results are not provided in real time, and availability varies by identifier and data provider. Results should not replace your own due diligence.

Do not use this Platform to stalk, harass, dox, or attempt to track or monitor any person. The Platform does not offer facial recognition, regulated identity verification, person-tracking, device monitoring, real-time location or GPS data, or access to private communications, accounts, or login credentials.

TraceCheck makes no representation or warranty about the character, integrity, or trustworthiness of any person, business, or entity identified through the Platform.
